Terms of Service

1. Acceptance of Terms

By purchasing or downloading CommerceForge ("the Product") you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not purchase or use the Product. These Terms constitute the entire agreement between you and CommerceForge ("we", "us") regarding the Product.

2. License

Upon purchase, we grant you a non-exclusive, non-transferable, perpetual license to use the Product for the number of stores specified in your pricing tier:

• Starter (€199) — 1 store.
• Pro (€449) — up to 5 stores.
• Agency (€1,499) — unlimited stores.

You may not resell, sublicense, or redistribute the source code as a standalone starter kit or template product.

3. Permitted Use

You may:

• Modify the code to build Shopify storefronts for yourself or your clients.
• Deploy to any hosting provider, including Shopify Oxygen.
• Remove or replace the CommerceForge branding in delivered projects.

You may not:

• Redistribute, resell, or share the original source code with third parties.
• Use the Product to build a competing starter kit, theme, or template product.
• Claim authorship of the base framework without substantial modification (≥50% of codebase).

4. Delivery

After successful payment, you will receive access to the private GitHub repository and/or a downloadable ZIP archive via the email address provided at checkout. Delivery is typically immediate but may take up to 24 hours in exceptional cases.

5. Refund Policy

Customers may request a refund within 7 days of purchase by contacting us at hello@commerceforge.dev. Refunds may be granted in cases such as duplicate purchases, delivery or access issues we are unable to resolve, or material issues with the Product. We reserve the right to refuse refund requests where the Product has been successfully delivered and no material issue is present.

6. Support

All plans include 30 days of email support from the date of purchase. Support covers setup questions and bugs in the original codebase. Custom development, feature requests, and integration work are outside the scope of included support and may be quoted separately.

7. Updates

License holders receive all patch and minor version updates free of charge for 12 months from the date of purchase. Major version upgrades may be offered at a discounted price.

8. Disclaimer of Warranties

The Product is provided "as is" without warranty of any kind. We do not guarantee that the Product will be error-free, uninterrupted, or fit for any particular purpose. Your use of the Product is at your sole risk.

9. Limitation of Liability

To the maximum extent permitted by law, CommerceForge shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Product, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the Product.

10. Governing Law

These Terms are governed by the laws of Italy. Any disputes shall be subject to the exclusive jurisdiction of the courts of Italy.

11. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Product after changes constitutes acceptance of the new Terms.
